This site is owned by BRG RADIO. BRG RADIO provides this Website and related services for your personal non-commercial use only, and subject to your compliance with this Terms of Use Agreement (the “Agreement”). Before using this website, please carefully read this Agreement and the current Website Privacy Policy (the “Privacy Policy”), which is incorporated by reference. Your use of this Website constitutes your acceptance to be bound by this Agreement and the Privacy Policy without limitation, qualification or change. Suppose at any time you determine that you do not accept all the terms and conditions of this Agreement and the Privacy Policy. In that case, you must immediately discontinue the use of this Website.
Certain products or services offered by this Website (each a “BRG RADIO Internet Service”, and collectively “BRG RADIO Internet Services”), and certain areas within this Website may be governed by additional terms (“Additional Terms”) (including without limitation, Contest Rules, as described in the Privacy Policy) presented in conjunction with those products or services. You must agree to these Additional Terms before using those areas or BRG RADIO Internet Services. The Additional Terms and this Agreement shall apply equally. In the event of an irreconcilable inconsistency between the Additional Terms and this Agreement, the Additional Terms shall control.
YOU MAY NOT USE THIS WEBSITE OR ANY BRG RADIO INTERNET SERVICE FOR ANY PURPOSE THAT IS UNLAWFUL OR PROHIBITED BY THIS AGREEMENT, THE PRIVACY POLICY, AND ANY APPLICABLE ADDITIONAL TERMS. YOUR ACCESS TO ANY BRG RADIO WEBSITE OR BRG RADIO INTERNET SERVICE MAY BE TERMINATED IMMEDIATELY AT BRG RADIO’S SOLE DISCRETION, WITH OR WITHOUT NOTICE, IF YOU FAIL TO COMPLY WITH ANY PROVISIONS OF THIS AGREEMENT AND ADDITIONAL TERMS OR FOR ANY OTHER REASON OR NO REASON.
Some parts of this Website may contain adult content intended for people at least 18 years old. By viewing this adult content, you are representing that you are at least 18 years old and that the content is acceptable. Changes to this Agreement, the Privacy Policy, and Applicable Additional Terms
BRG RADIO reserves the right, in its sole discretion, to modify, alter, or otherwise change this Agreement, any Additional Terms, and the Privacy Policy at any time.. Your continued use of this Website after the date of any changes to the Agreement, any Additional Terms, and the Privacy Policy will constitute your acceptance and agreement to be bound by those changes without limitation, qualification or change. If at any time you determine that you do not accept these changes. In that case, you must immediately discontinue using this Website and the BRG RADIO Internet Service to which the changes apply.
Privacy, Children’s Privacy, and Protection of Personal Information
BRG RADIO has developed a Privacy Policy to inform you of its practices regarding collecting, using, and disclosing personal information.
Neither this Website nor any BRG RADIO Internet Service is directed to children younger than 13 years old, nor does BRG RADIO knowingly collect any personal information from such children. BRG RADIO’s policy is to delete any personal information concerning a child upon discovery immediately. When a user discloses personal information on the Website or concerning any BRG RADIO Internet Service, they represent their age as at least 13 years.
Consistent with the Privacy Policy, BRG RADIO reserves the right to disclose personal information as required or authorised by applicable law.
Accounts, Security, and Passwords
Suppose the Website or BRG RADIO Internet Service requires you to open an account. Fees
Except where otherwise provided herein, in the Privacy Policy, or in the Additional Terms, access to and use this Website and the BRG RADIO Internet Services offered through this site are currently available without charge. BRG RADIO reserves the right to charge a fee for access to or use this Website or any BRG RADIO Internet Service available on this Website at any time. Your access to or use of this Website or BRG RADIO Internet Services offered through this site before such time does not entitle you to use this Website without charge in the future.
Use of Intellectual Property
The Website and all of its contents, including but not limited to articles, other text, photographs, images, illustrations, graphics, video material, audio material, including musical compositions and sound recordings, software, BRG RADIO logos, titles, characters, names, graphics and button icons (collectively “Intellectual Property”), are protected by copyright, trademark and other laws of the United States, as well as international conventions and the laws of other countries. The Intellectual Property is owned or controlled by BRG RADIO or other parties that have provided rights to BRG RADIO. You, as a result of this, agree that you will not reproduce, download, license, publish, enter into a database, display, modify, create derivative works from, transmit, post, distribute or perform publicly by any means, method, or process now known or later developed, decompile, reverse engineer, disassemble, use on another computer-related environment, transfer or sell any Intellectual Property, information, software or products obtained from or through this Website, in whole or in part, without the express written permission of BRG RADIO.
Other trademarks, service marks, product names, company names, or logos appearing on this Website that are not owned by BRG RADIO may not be used without express permission from their owners.
Additionally, unless otherwise expressly permitted, websites may not frame this Website, or any web page or material herein, nor may any entity include a hyperlink to any aspect of the Website in an e-mail for commercial purposes, without the express written permission of BRG RADIO.
Procedure for Making Claims of Copyright Infringement
BRG RADIO respects the Intellectual Property rights of third parties and complies with the terms of the Digital Millennium Copyright Act (“DMCA”) regarding such rights. By submitting any material to this BRG RADIO Website, you are granting permission to have this material posted on this BRG RADIO Website, and you are representing that you are the rightful owner of the submitted material and that no one else may claim rights to this material. BRG RADIO reserves the right to remove access to infringing material. Such actions do not affect or modify any other rights BRG RADIO may have under law or contract.
We may remove or restrict access to the material when we receive a valid notice. Your notice will be forwarded to the person allegedly infringing your copyrighted material, who may then send us a counternotification.
If we receive a valid counter-notification, we will notify you and provide you with a copy of the counter-notification we received. (b) that you have obtained all necessary clearance, releases, licenses, and rights to post the User Content through the BRG RADIO Internet Services;

By posting User Content through BRG RADIO Internet Services, you further agree to indemnify and hold harmless BRG RADIO, its corporate parent(s), subsidiaries, affiliate(s), and their respective officers, directors, and employees from any claims, liabilities, costs, or expenses, including, without limitation, reasonable attorney and other professional fees, arising from (a) your breach of any of the representations and warranties contained in this “User Content” section of these Terms of Use; (b) the User Content you post through the BRG RADIO Internet Services; (c) BRG RADIO’s use, publication, distribution, or broadcast of User Content that you post; or (d) your use of BRG RADIO Internet Services.

YOUR USE OF, AND RELIANCE ON, ANY ADVICE OR INFORMATION OBTAINED FROM OR THROUGH THE BRG RADIO WEBSITE AND ANY BRG RADIO INTERNET SERVICE IS AT YOUR OWN RISK. Limitations on Liability

Any software that is made available to view and download in connection with the Website or a BRG RADIO Internet Service (“Software”) is owned or controlled by BRG RADIO or its licensors, affiliates and suppliers and is protected by copyright laws and international treaty provisions. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software. If no such end user license agreement accompanies or is included with the Software, this Terms of Use Agreement and the Privacy Policy govern your use of the Software. BRG RADIO accepts no responsibility or liability concerning software owned, controlled, or distributed by third parties.
Mobile Services
Although BRG RADIO presently does not charge you a fee to use any mobile version of the Website or Software designed for use on mobile devices (the “Mobile Services”), it reserves the right to do so in the future. Please check the terms of the wireless Internet service plan you use in connection with any mobile Software because your carrier’s per-minute, text messaging, and data rates may apply. You are solely responsible for the costs of any equipment and connections required to use the Mobile Services.
Internet Radio
You may access for your personal use only the radio signal transmitted through a BRG RADIO Internet Service (the “Internet Radio Service”) or a link provided on the Website. You may not rebroadcast the Internet Radio Service in any way. You may not make any recordings of, or otherwise duplicate, content or information provided by the Internet Radio Service through any means. In addition, you may not re-transmit or otherwise distribute the content or information provided by the Internet Radio Service in any way, including by online streaming such content or making such content available for download. You may not re-skin, re-package, decompile, reverse engineer, or disassemble the Internet Radio Service or construct a media player or interface that accesses the Internet Radio Service, including by weblink that bypasses the website’s home page. In addition, your use of any products or services that access the Internet Radio Service and which are provided by third parties not authorized by us constitutes a violation of this Agreement, even if you did not create such product or services and do not understand how they were made.
Third-Party Merchants
This Website may permit you to order and receive products, information and services from businesses not owned or operated by BRG RADIO and our affiliate(s). The purchase, payment, warranty, guarantee, delivery, maintenance, and all other matters concerning the merchandise, services information, opinion or advice ordered or received from such businesses are solely between you and such companies. BRG RADIO does not endorse, warrant or guarantee such products, information or services and is not liable for the accuracy, completeness or usefulness of such information, opinion or advice or the quality or availability of such products or services. BRG RADIO will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products, services or information or for ensuring the confidentiality of your credit card information. You are responsible for any charges or obligations you incur in your dealings with these third parties. They are not part of the fee, if any, charged for the BRG RADIO Internet Service.
Modification/Termination by BRG RADIO
BRG RADIO respects the intellectual property rights of third parties. Accordingly, you may not store any material on the Internet Service or use BRG RADIO’s systems or servers in any manner that constitutes an infringement of third-party intellectual property rights, including under U.S. copyright law. Per the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, it is the policy of BRG RADIO to suspend or terminate, in appropriate circumstances, the Internet Service provided to any subscriber or account holder who is deemed to infringe third-party intellectual property rights, including repeat infringers of copyrights. In addition, BRG RADIO expressly reserves the right to suspend, terminate or take other interim action regarding the Internet Service of any user if BRG RADIO, in its sole judgment, believes that circumstances relating to an infringement of third-party intellectual property rights warrant such action. These policies also do not affect or modify any other rights BRG RADIO may have under law or contract.
In addition, BRG RADIO reserves the right, in its sole discretion, to modify, suspend, or terminate this Website and any portion thereof, including any BRG RADIO Internet Service, and your account, password, or use of any BRG RADIO Internet Service, or any portion thereof, at any time for any reason, or no reason, with or without notice to you.
Any termination of your account for a BRG RADIO Internet Service removes your authorization to use the BRG RADIO Internet Service. In the event of termination, you will still be bound by your obligations under this Agreement and any Additional Terms, including the warranties you made and the disclaimers and limitations of liability. Additionally, BRG RADIO shall not be liable to you or any third party for any termination of your access to a BRG RADIO Internet Service.
Indemnification
You agree to indemnify, defend, and hold harmless BRG RADIO, its subsidiaries, agents, distributors and affiliates, and their officers, directors and employees from and against any claims, actions, demands, liabilities, costs and expenses, including, without limitation, reasonable attorneys’ fees, resulting from your breach of any provision of this Agreement, the Additional Terms, or any warranty you provide herein, or otherwise arising in any way out of your use of this Website and any related BRG RADIO Internet Service and Software. BRG RADIO reserves the right to take exclusive control and defence of any such claim otherwise subject to your indemnification. In this event, you will cooperate fully with BRG RADIO in asserting any available defences.
International Use/U.S. Export Controls
Accessing the materials on this Website by certain persons in certain countries may not be lawful, and BRG RADIO makes no representation that materials on this Website are appropriate or available for use in locations outside the United States. If you choose to access this Website from outside the United States, you do so at your own risk and initiative. You are responsible for compliance with any applicable local laws.

General Information
This Agreement, any Additional Terms, and the Privacy Policy shall be governed by, construed and enforced by the laws of the State of California, as it is applied to agreements entered into and performed entirely within such state, without regard to conflict of law principles. You agree that any cause of action you or BRG RADIO brings to enforce this Agreement, any Additional Terms, and the Privacy Policy, or in connection with any matters related to this Website and a BRG RADIO Internet Service, shall be brought only in either the state or Federal courts located in California. You agree to submit to the personal jurisdiction of the courts of the State of California for any cause of action arising out of this Agreement, any Additional Terms, and the Privacy Policy, or in connection with any matters related to this Website and a BRG RADIO Internet Service. You agree to file any cause of action concerning this Agreement, any Additional Terms, and the Privacy Policy, or in connection with any matters related to this Website and a BRG RADIO Internet Service within six months after the cause of action arises. You agree that a cause of action filed after this date is barred.
If any provision of this Agreement, any Additional Terms, and the Privacy Policy, or the application thereof to any person or circumstances, is held invalid or for any reason unenforceable, including, but not limited to, the warranty disclaimers and liability limitations, then such provision shall be deemed superseded by a valid, enforceable provision that matches, as closely as possible, the original provision, and the other provisions of this Agreement, the Additional Terms and the Privacy Policy shall remain in full force and effect. The failure of either party to insist upon strict performance of any provision of this Agreement, the Additional Terms, and the Privacy Policy shall not be construed as a waiver of any provision or right. Unless expressly provided otherwise, this Agreement, any Additional Terms, and the Privacy Policy constitute the entire agreement between you and BRG RADIO concerning the use of this Website and shall not be modified except in writing, signed by an authorized representative of BRG RADIO.

Procedure for Making a Claim of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, you should send written notification thereof to contact@brg-radio.com
Under 17 U.S.C. §512(c), to be effective, the Notification must include the following:
1) The physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed;
2) A description of the copyrighted work claimed to have been infringed, or if a single notification covers multiple copyrighted works at a single online site, a representative list of such works at that site, and a description of the infringing activity;
3) Identification of the specific location on this Website where the material claimed to be infringing is located, described sufficiently to allow BRG RADIO to find the material;
4) Identification of the specific location where the original or an authorized copy of the copyrighted work exists;
5) Information reasonably sufficient to permit BRG RADIO to contact you, such as your name, address, telephone number, and, if available, an electronic mail address;
6) A statement by you that you have a good faith belief that use of the material in the manner described in the Notification is not authorized by the copyright owner, its agent, or the law; and

This process only relates to reporting a claim of copyright infringement. Messages related to other matters will not receive a response through this process.
Procedure for Making Counter Notification
To file a counter-notification with us, you must provide a written communication that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are unsure whether a particular material infringes the copyrights of others, we suggest that you first contact an attorney. To expedite our ability to process your counter-notification, please use the following format (including section numbers):
Your communication must include substantially the following:
1) A physical or electronic signature of the subscriber.
2) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
3) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification of the material to be removed or disabled.
4) Your name, address, and telephone number.
5) The following statement: “I consent to the jurisdiction of the Federal District Court in the District of California and any judicial district in which the service provider may be found, and I will accept service of process from the claimant or an agent of the claimant.”
6) The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
